1. General

These Terms govern the use of the website operated by Association Willow, a Swiss non-profit association with its seat in the Canton of Geneva (Switzerland), and any donations made through this website.

2. Statutory Purpose

Association Willow is created to support the professionalisation of the legal profession in Eastern Europe and its capacity to undertake pro bono legal work in the public interest, as set out in the Association’s Statutes. The Association is non-profit.

3. Nature of Donations

Donations made to Association Willow are voluntary, irrevocable gifts and are not payments for goods or services. Donations and legacies may be accepted but are not actively solicited and may be reviewed against rigorous ethical and moral criteria. The Association may decline or return a donation where acceptance would be inconsistent with its statutory purpose or applicable law.

4. Payment Processing

Online donations are processed via Stripe. Association Willow does not store full payment card details. Your payment may be subject to Stripe’s terms and policies as an independent provider. Currency conversion, if any, may be performed by your bank or payment provider.

5. Refund Policy

Donations are generally non-refundable: As donations are charitable gifts, there is no entitlement to a refund. If you believe an error has occurred (e.g., duplicate transaction or incorrect amount), please contact us at [email protected] within 14 days. Where appropriate, refunds may be granted at the discretion of the Board and subject to the capabilities and rules of the payment provider.

6. Allocation of Funds

All resources of the Association shall be used exclusively for its not-for-profit purposes. Donations are used to fund the Association’s activities as defined in its Statutes. The Board may allocate funds to specific projects or partner organisations within the scope of the statutory purpose.

7. Website Use

You agree not to misuse this website, attempt unauthorised access, interfere with its operation, or use it in a way that violates applicable laws.

8. Limitation of Liability

The Association is liable only for intent and gross negligence to the extent permitted by Swiss law. We are not liable for the content of external links, including third-party payment processors.

9. Applicable Law and Jurisdiction

These Terms are governed by Swiss law. The place of jurisdiction is Geneva, Switzerland.

10. Prevailing Language of the Statutes

In case of discrepancies regarding the Association’s Statutes, the original French version shall prevail.
